In giving this issue some further thought, I think that the problem might be better approached through other methods. I think that the California supreme court should be forced to rule on the constitutionality of the state issuing a “marriage” license, an institution, I think all will agree, which was the manifestation of the church. In my mind, this is a separation of church and state issue, and the state should not be issuing “marriage” licenses to anyone, but rather only civil unions; churches would still conduct marriages, but only upon election of the participants. Although such an approach/argument would never be approved by the populi in this environment, it might hold substantial weight in the courts…

I think that the California supreme court should be forced to rule on the constitutionality of the state issuing a “marriage” license, an institution, I think all will agree, which was the manifestation of the church. In my mind, this is a separation of church and state issue, and the state should not be issuing “marriage” licenses to anyone, but rather only civil unions; churches would still conduct marriages, but only upon election of the participants.
